1. Definitions

COMPANY NAME SRL. – KODING TECHNOLOGY SRL company, organized under Romanian law.

website – The domain www.kodingtech.com and its subdomains. 

CONTENT has the following definition:

  • all information on the SITE that can be visited, viewed or otherwise accessed using digital equipment;
  • the content of any e-mail sent to its USERS or CUSTOMERS by www.kodingtech.com by electronic means and/or any other available means of communication;
  • any information communicated by any means by an employee of www.kodingtech.com to the USER or CLIENT, according to the contact information, whether or not specified by the latter;
  • information related to the products, services and/or rates charged by www.kodingtech.com during a certain period;
  • information related to the products, services and/or rates charged by a third party with which www.kodingtech.com has concluded partnership contracts, during a certain period;
  • data relating to www.kodingtech.com, or other privileged data thereof.

SERVICE – the e-commerce service conducted exclusively on the publicly available portions of the SITE, in the sense of granting the CLIENT the possibility to contract products and/or services using exclusively electronic means, including other means of distance communication (ie by telephone).

member – The natural person who has or obtains access to the CONTENT, through any means of communication (electronic, telephone, etc.) or based on a usage agreement between www.kodingtech.com and it and which requires the creation and use of an ACCOUNT.

ACCOUNT – the set consisting of an e-mail address and a password that allow a single MEMBER access to restricted areas of the SITE through which access to the SERVICE is made.

CLIENT – The natural person who has or obtains access to the CONTENT and SERVICE, after creating the MEMBER ACCOUNT.

DOCUMENT – these Terms and Conditions

DISTANCE CONTRACT – according to the definition contained in Emergency Ordinance no. 34 of 2014 art. 2.7.: any contract concluded between a professional and a consumer within an organized distance sales or service provision system, without the simultaneous physical presence of the professional and the consumer, with the exclusive use of one or more means of distance communication, up to and including the moment it is contractually concluded.

NEWSLETTER/ALERT – the means of periodic information, exclusively electronic, on the products, services and/or promotions carried out by www.kodingtech.com during a certain period, without any commitment from www.kodingtech.com with reference to the information contained therein.

TRANSACTION – collection or reimbursement of an amount resulting from the sale of a product / service by www.kodingtech.com to the Client, by using the services of the card processor approved by kodingtech.com, regardless of the delivery method.

IN STOCK – the product is in physical stock and can be delivered based on an online order, AFTER ORDER CONFIRMATION. Orders for products with the IN STOCK status will be honored in the chronological order in which they are registered in the database. All products displayed with the IN STOCK status have a limited number of pieces. Stock updates are made according to the above mentioned – Consequently, situations may arise in which a product ordered with IN STOCK status becomes unavailable if it was confirmed on a previous order.

SUPPLIER STOCK – the product is in the supplier's warehouse and can be picked up or delivered after checking the stock at the supplier. Since the information is taken from the supplier, we do not assume responsibility if the respective product is not in stock.


2. General

2.1. The document establishes the terms and conditions of use of the Site/Content/Service by the Member or Client, if the latter does not have another valid user agreement concluded between www.kodingtech.com and him/her.

2.2. The use, including but not limited to accessing, visiting and viewing, of the Content/Service, implies the Member's or Client's adherence to these terms and conditions unless the respective content does not have distinctly formulated conditions of use.

2.3. Access to the Service is made exclusively by accessing the publicly available website www.kodingtech.com

2.4. By using the Site/Content/Service, the Member or Client is solely responsible for all activities arising from its use. He/she is also liable for any material, intellectual or electronic damages or any other nature caused to the Site, the Content, the Service, www.kodingtech.com or any third party with whom www.kodingtech.com has concluded contracts, in accordance with the Romanian legislation in force.

2.5. If the User or Client does not agree and/or does not accept and/or revokes their consent to the Document:

  • 2.5.1. He renounces: access to the Service, other services offered by www.kodingtech.com through the Site, receipt of newsletters/alerts and/or communications from www.kodingtech.com of any nature (electronic, telephone, etc.), without any further guarantee from www.kodingtech.com.
  • 2.5.2. www.kodingtech.com will delete all data referring to it from its database, without any subsequent obligation of either party to the other or without either party being able to claim damages from the other.
  • 2.5.3. He may at any time reverse his decision not to agree and/or not to accept the document, in the form in which it will be available at that time.

2.6. The Client / Member may at any time reverse his decision to agree and/or accept the Document, in the form in which it will be available at that time.

2.7. To exercise the right provided for in art 2.5, he may contact www.kodingtech.com, or use the links in the content received from www.kodingtech.com intended for this purpose.

2.8. The Client cannot revoke the consent expressed in favor of the Document during the period of a Contract or until the Client pays the value of all unfulfilled contracts to www.kodingtech.com.

2.9. If the Customer has paid the value of all unfulfilled Contracts to www.kodingtech.com and revokes his consent expressed in favor of the Document during the execution of an Order, www.kodingtech.com will cancel his Order without any further obligation of either party to the other or without either party being able to claim damages from the other.

2.10. This Site is addressed only to individual Members who are at least 18 years old, who have completed the appropriate registration steps and who have not been suspended or removed by kodingtech.com, regardless of the reason for suspension or removal. The possibility of ordering online is available only to persons domiciled in Romania. By becoming a Member, the person declares that he meets the aforementioned conditions.

3. Content

3.1. The content, as defined in the preamble, including but not limited to logos, stylized representations, commercial symbols, static images, dynamic images, text and/or multimedia content presented on the Site, are the exclusive property of kodingtech.com, with all rights obtained in this regard directly or indirectly (through licenses for use and/or publication) being reserved.

3.2. The Member or Client is not permitted to copy, distribute, publish, transfer to third parties, modify and/or otherwise alter, use, link to, display, include any content in any context other than the original one intended by kodingtech.com, include any content outside the kodingtech.com website, remove the signs signifying the copyright of www.kodingtech.com on the content, as well as participate in the transfer, sale, distribution of materials created by reproducing, modifying or displaying the content, except with the express consent of kodingtech.com.

3.3. Any content to which the Member or Client has and/or obtains access by any means is subject to the Document, if the content is not accompanied by a specific and valid user agreement concluded between www.kodingtech.com and it, and without any implicit or express warranty made by www.kodingtech.com with reference to that content.

3.4. The Member or Client may copy, transfer and/or use content only for personal or non-commercial purposes, only if these do not conflict with the provisions of the Document.

3.5. If www.kodingtech.com grants the Member or Client the right to use, in the form described in a separate user agreement, a certain content, to which the Member has or obtains access pursuant to this agreement, this right extends only to that content or contents defined in the agreement, only during the existence of it or these contents on the site or the period defined in the agreement, according to the defined conditions, if they exist and does not represent a contractual commitment on the part of www.kodingtech.com for the respective Member, Client or any other third party who has/obtains access to this transferred content, by any means and who could be or is prejudiced in any way as a result of this content, during or after the expiration of the user agreement.

3.6. No content transmitted to the Member or Client, by any means of communication (electronic, telephone, etc.) or acquired by him/her through access, visit and/or viewing does not constitute a contractual obligation on the part of www.kodingtech.com and/or the www.kodingtech.com employee who mediated the transfer of content, if any, with respect to the respective content.

3.7. Any use of the Content for purposes other than those expressly permitted by the document or the accompanying user agreement, if any, is prohibited.

4. Contact

4.1. www.kodingtech.com publishes on the site complete and correct identification and contact data of the Client or Member.

4.2. By using the contact form or service present on the site, the Member or Client allows www.kodingtech.com to contact him by any available means, including electronic means.

4.3. Partial or full completion of the contact form and its submission does not in any way represent a commitment on the part of www.kodingtech.com to contact the Member or Customer.

4.4. Accessing the Site, using the information presented within it, visiting the pages or sending e-mails or notifications addressed to www.kodingtech.com is done electronically, by telephone, or any other means of communication available to the Member or Client and www.kodingtech.com, thus being considered that he consents to receiving notifications from www.kodingtech.com electronically and/or by telephone, including communications by e-mail or through announcements on the site.

4.5. www.kodingtech.com reserves the right not to respond to all requests of any nature, received through any means of communication (electronic, telephone, etc.).

5. Newsletters and alerts

5.1. When the Member or Client creates an Account on the Site, accepting the Document (Terms and Conditions), he has the right to express or not his agreement regarding the receipt of newsletters and/or alerts from kodingtech.com.

5.2. The data taken from the Member for the purpose of sending newsletters and/or alerts can and will be used by www.kodingtech.com within the limits of the Privacy Policy.

5.3. The Member or Client may opt out of receiving newsletters and/or alerts at any time:

  • 5.3.1. Using the specially designated link within any newsletters and/or alerts received.
  • 5.3.2. By changing your consent to receive newsletters and/or alerts and using pages in restricted areas, by using the Account.
  • 5.3.3. By contacting kodingtech.com, according to the contact information, and without any further obligation of either party to the other or without either party being able to claim damages from the other.

5.4. Opting out of receiving newsletters and/or alerts does not imply waiving the acceptance given for the document.

5.5. www.kodingtech.com reserves the right to select the persons to whom it will send newsletters and/or alerts, as well as the right to remove from its database any Member or Client who has previously expressed consent to receive newsletters and/or alerts, without any subsequent commitment from kodingtech.com, or any prior notification thereof.

5.6. www.kodingtech.com will not include in newsletters and/or alerts sent to the Member or Client any other type of advertising material in the form of content that refers to any third party that is not a partner of kodingtech.com, at the time of sending the newsletters and/or alerts.

6. Confidentiality

6.1. The processing of customers' personal data is carried out in accordance with the laws in force and is stipulated on the privacy page. Privacy policy, which is an integral part of this contract. 

7. Online sales policy

7.1. Access to the service

  • 7.1.1. Access to the service is allowed to any Member who possesses or creates an Account.
  • 7.1.2. In order to be allowed access to the service, the Member will have to accept the provisions of the Document.
  • 7.1.3. www.kodingtech.com reserves the right to limit the client's access to the Service and to delete his/her Account if it considers that based on the behavior of the Client, the access and existence of the Client's Account could in any way harm kodingtech.com.
  • 7.1.4. Each Member may have only one Account. Sharing an Account between multiple Members/Clients is prohibited.
  • 7.1.5. In the event that such access is discovered, www.kodingtech.com reserves the right to cancel or suspend the Client's access to the Content or Service.

7.2. Products and services

  • 7.2.1. www.kodingtech.com may publish on the site information about products, services and/or promotions practiced by it or by any other third party with which www.kodingtech.com has concluded partnership contracts, within a certain period and within the limit of available stock.
  • 7.2.2. Products and/or services purchased through the service are intended exclusively for the personal use of the Customer.
  • 7.2.3. www.kodingtech.com may limit the ability to purchase certain products or services available on the site at a given time, to one or more Customers.
  • 7.2.4. All prices for products or services presented on the site are expressed in lei (RON) with VAT included.
  • 7.2.5. The prices displayed on the site crossed by a line signify the price recommended by the manufacturer for sale in stores, shopping centers or any other commercial spaces where discounts are not practiced. These prices are purely informative and have no legal value.
  • 7.2.6. The billing of purchased products is made exclusively in RON. If the payment is made by bank card, this will be confirmed when the invoice is issued to the Client. Until that moment, the order value will be blocked on the Client's account and will not be transferred to the kodingtech.com accounts.
  • 7.2.7. In the case of online payments www.kodingtech.com is not/cannot be held responsible for any additional costs incurred by the customer, including but not limited to currency conversion fees applied by the issuing bank of his card, if the currency of issue differs from RON. The responsibility for this action lies solely with the customer.
  • 7.2.8. All information used to describe the products and/or services available on the site (static / dynamic images / multimedia presentations / etc.) does not represent a contractual obligation on the part of Www.kodingtech.com, as these are for presentation purposes only.
  • 7.2.9. In the description of products and/or services www.kodingtech.com reserves the right to use other products (accessories/etc.) that may not be included in the costs of the respective products.
  • 7.2.10 If prices or other details regarding products were displayed incorrectly, including due to the fact that they were entered incorrectly in the database, we reserve the right to CANCEL orders containing these products and to notify customers as soon as possible about the error.

7.3. Online ordering

  • 7.3.1. The customer can place orders for products sold at a given time, exclusively on the site.
  • 7.3.2. By completing the order, the Customer agrees that all data provided by him, necessary for the purchase process, are correct, complete and true at the date of placing the order, referred to in this document as the "issued order"„
  • 7.3.3. By completing the order, the Customer agrees that www.kodingtech.com may contact him, by any means available / agreed by kodingtech.com, in any situation in which it is necessary to contact the Customer.
  • 7.3.4. www.kodingtech.com may unilaterally terminate the order placed by the Client, following prior notification to the Client, without any subsequent obligation of either party to the other or without either party being able to claim damages from the other in the following cases:
    • 7.3.4.1. non-acceptance by the issuing bank of the Customer's card of the transaction, in the case of online payment;
    • 7.3.4.2. invalidation of the transaction by the card processor approved by kodingtech.com, in the case of online payment;
    • 7.3.4.3. the data provided by the Client on the site is incomplete or incorrect;
    • 7.3.4.4. the Client's activity on the site may and/or cause damages of any kind to www.kodingtech.com and/or its partners;
    • 7.3.4.5. making more than two consecutive, failed deliveries;
    • 7.3.4.6. for other objective reasons;
    • 7.3.4.7. unavailability of products in suppliers' stock.
  • 7.3.5. The customer may cancel an order placed when contacted according to art. 7.3.3.
  • 7.3.6. In case the Customer cancels an order made with payment by bank card and in which the issuing bank of the Customer's card has authorized the bank transaction, in the sense of blocking in the Customer's account the equivalent value of the products and services purchased by him, this amount will be unblocked by www.kodingtech.com within a maximum of 48 hours from the date on which www.kodingtech.com became aware of this fact.
  • 7.3.7. If some products ordered by the Client through an order made with a bank card payment are not available in stock, www.kodingtech.com will inform the client of this fact and will order the release of the value of these products from the Client's account, if this amount was blocked on the Client's card, within a maximum of 48 hours from the date on which www.kodingtech.com became aware of this fact.
  • 7.3.8. If the customer has chosen the payment method by bank card, and the value of the ordered products/services has been blocked on his card, he has the right to modify the content of his order, when contacted by Www.kodingtech.com, within the limit of the value blocked on his card.
  • 7.3.9. If the Customer has modified his Order according to art 7.3.8, and the value of his new order is lower than the value of the products/services initially ordered, www.kodingtech.com will order the release of the difference between the value of the initial order and the new order into the Customer's account, within a maximum of 48 hours from the date on which www.kodingtech.com became aware of this fact.
  • 7.3.10. The product delivery details, including but not limited to the time required for delivery, do not constitute a contractual obligation on the part of Www.kodingtech.com, without any party being able to claim damages from the other, in the event that any party may be or is prejudiced in any way as a result of their breach.
  • 7.3.11. If a Client modifies their personal data, using the forms available on the site, all ongoing orders existing at that time retain the data defined/accepted by the Client before the modification, taking into account for delivery and contact, the new data modified accordingly.

7.4. Telephone order

  • 7.4.1. The Customer/Member may place orders by telephone.

7.5. Contract and completion

  • 7.5.1. www.kodingtech.com will include in the package sent to the Client, depending on the type of each product, all the necessary documents to certify the purchase of the products/services by the Client.
  • 7.5.2. www.kodingtech.com will facilitate informing the Customer about the completion stage of his order.
  • 7.5.3. The contract to which the documents certifying the delivery to the Client of the products contracted by him, by kodingtech.com, are added, becomes an honored Contract.

7.6. Transportation

  • 7.6.1. Delivery to the Customer of the purchased products/services is carried out through a courier company.
  • 7.6.2. Deliveries will usually be made between 2 and 4 working days from the confirmation of the order. However, we reserve the right for products that are not in the internal stock of the store or the national importer / distributor, the delivery time to be longer. In this case, the customer will be informed about the need for special import, and the delivery time will be communicated by e-mail. The product will be ordered after accepting the mutually agreed conditions. If the import of the product is postponed, for reasons beyond the control of kodingtech.com, the customer will be notified within 2 working days about the changes to the delivery time with the application of the provisions of art. 7.7.3, in which case, the Customer may cancel the order in writing. In the event that payment was made before the delivery date of the ordered product / products, the amounts paid will be refunded in full according to the law, within a maximum of 14 days.
  • 7.6.3 Customers will be contacted by phone or email and will be informed of the delivery times.

7.7. Quality and guarantees

  • 7.7.1. Each product sold by www.kodingtech.com benefits from the warranty period mentioned in the product warranty certificate. Clear details related to the characteristic features of each product are communicated on the site on the presentation page of each product sold within the Campaign, and information regarding the terms and conditions of granting the warranty by the manufacturers or importers of the respective products, as well as the instructions for using the different types of products are transmitted in the form of a document available in each package. No member may request an extended warranty unless there is a clearly distinct sales option, under other terms and conditions and/or beyond the warranty period granted by the warranty certificate. The product warranty offered by www.kodingtech.com is granted in compliance with the applicable legislation in the matter and is based on obtaining, as the case may be, certificates of authenticity and/or certificates of conformity for products purchased directly from manufacturers and/or their authorized distributors.
  • Each product sold by www.kodingtech.com benefits from a guarantee of conformity according to the provisions of Law 449/2003.
  • In accordance with art. 11 of Law 449/2003, each Member or Customer may request, in the event of lack of conformity, repair, replacement of the product or refund of its value. Product replacement is possible within the limit of available stock.
  • 7.7.2. In the event that www.kodingtech.com cannot execute the contract due to the product being unavailable, it will inform the Customer of this unavailability, on the date on which www.kodingtech.com becomes aware of this case. In the event that the product has already been paid for by the Customer, the amounts paid as payment will be reimbursed by www.kodingtech.com within a maximum period of 14 days, unless the parties agree otherwise.
  • 7.7.3. In the event of exceeding the delivery period indicated in art. 7.6.2, www.kodingtech.com will inform the Customer by e-mail and will agree with him to extend the delivery period by a period that will not exceed the initially stipulated delivery period. If, within the new mutually agreed period, the product will be unavailable for delivery, the Customer may request the termination of the distance contract and the cancellation of the order. The Customer has a period of 2 working days from the date of issuing the information notification to express his option regarding the ordered product. The lack of receipt by www.kodingtech.com of a response from the Customer within the specified period will be considered as his tacit acceptance of the extension of the delivery period. In all cases where the Customer expresses his option in writing to terminate the contract and cancel the order, if the product has already been paid for by him, www.kodingtech.com will refund the amounts paid according to art. 7.6.2.
  • 7.7.4. The amounts paid will be reimbursed within 14 days to the extent that www.kodingtech.com has all the necessary information in this regard, namely the communication by the client in writing of the IBAN account to which the amounts paid will be transferred.

7.8. Return of products

  • 7.8.1. Except for the limitations of art. 7.9 regarding coupons, the www.kodingtech.com Customer may return products purchased through a Contract, in the following situations:
    • 7.8.1.1. The packages show severe damage;
    • 7.8.1.2. The products were delivered/invoiced incorrectly;
    • 7.8.1.3. The products have manufacturing defects;
    • 7.8.1.4. The products have different dimensions or specifications than those presented or erroneously ordered by the Customer;
    • 7.8.1.5. "The consumer has the right to notify the trader in writing that he/she withdraws from the purchase, without penalty and without giving any reason, within 14 days of receiving the product." Also, in accordance with Emergency Ordinance no. 34 of 2014, the Customer has the right to unilaterally terminate the distance contract, within 14 days of receiving the product/products, without penalty and without giving any reason. In this case, the direct costs of returning the products will fall, according to the law, on the Customer's responsibility.
  • 7.8.2. The customer undertakes to notify Www.kodingtech.com of his intention to return the purchased products, by any means of written communication (e-mail/fax/etc) within a maximum of 14 days from receipt of the products and/or services.
  • 7.8.3. The customer who notified www.kodingtech.com according to art 7.8.2 is responsible for ensuring that the products to which he referred will be returned within a maximum of 14 days, otherwise, www.kodingtech.com will consider the request unfounded/invalid and may refuse the return.
  • 7.8.4. www.kodingtech.com may refuse products returned by its Customers, if the return falls into one of the cases provided below, without the latter claiming damages or compensation:
    • 7.8.4.1. In the case of replacing the purchased product with another product with different specifications or of a different type, except for the situation provided for in art. 7.8.1.4.
    • 7.8.4.2. If the return request for any of the situations provided for in art. 7.8.1 has a date of dispatch of the notification of the intention to return that exceeds the 10 working day period provided for in art. 7.8.2, calculated from the working day immediately following the date of the honored contract.
    • 7.8.4.3. In the event that a product is returned for one of the reasons set out in art. 7.8.1, and the returned product is not in the same condition in which it was delivered (in the original packaging with all labels intact and accompanying documents).
    • 7.8.4.4. For clarification, in the event that the Client notifies the intention to unilaterally terminate the contract according to art. 7.8.1, a situation that entails the obligation on the part of www.kodingtech.com to reimburse the amounts paid by the Client within 14 days, the mentioned term will become due starting with the date on which the product was received by Www.kodingtech.com and not from the date on which the Client transmitted to www.kodingtech.com his intention to terminate.
    • 7.8.4.5. According to Emergency Ordinance no. 34 of 2014 www.kodingtech.com reserves the right not to accept the return of products that, by their nature, cannot be returned or that may degrade or deteriorate quickly. Products that constitute a kit must be returned as a kit.
  • 7.8.5. In the event of a refund of the product value, this will be made no later than 14 days from confirmation of the return.
  • 7.8.6. The returned product must be in the same condition in which it was delivered (with all accessories, intact labels and accompanying documents). Return costs and bank fees will be borne by the buyer and will be deducted from the amount to be returned. If the product is returned in a condition in which it can no longer be sold as new, we reserve the right to request a fee for restoring it to its original condition (if possible), or to cover the price difference resulting from selling the product as second-hand or, at the customer's option, we will reship the product at their expense.

Other notes related to product returns

Products in one or more of the following situations cannot be returned:

Products that cannot be returned:

Products brought on "special order" (SPECIAL ORDER is defined as the list of products ordered by the Beneficiary and which are not in the Supplier's usual stock but which can be delivered based on a firm order and payment of an advance, on the terms agreed upon by the parties). 
The product no longer has the complete original packaging in which it was delivered;
The product or packaging identification labels are damaged or missing;

If the delivered product does not meet the specifications on the site, it can be returned at no additional cost to the customer, after a written notification has been sent by the customer specifying the lack of conformity of the product within a maximum of 24 hours from delivery. The customer can request the replacement of the product or the return of its value.

Upon delivery of the package, the customer has the right to refuse products whose packaging has been damaged. For evidence, the package can be photographed and a report can be drawn up together with the courier company representative, mentioning the condition of the package at the time of delivery.

The shipping cost resulting from the return of the products will be paid by the customer.

  • 7.8.7. In the event that the Customer has returned a product in accordance with the provisions of art 7.8.1.3, and www.kodingtech.com does not have a suitable product for replacement, it will offer the customer the value of the product in accordance with 7.8.5.
  • 7.8.8. The value of additional services, including but not limited to the transportation of products, paid by the customer, is not refundable.
  • 7.8.9. In all cases, the return/re-shipment costs will be borne by the customer, with the exception of the situations presented in points 7.8.1.1; 7.8.1.2; 7.8.1.3 as well as in the case of lack of conformity according to 7.8.1., in which case www.kodingtech.com will bear the cost of the transport. Also, in the case of the delivery of an unordered product(s), according to chap. 7.3., the return costs are borne by kodingtech.com.

8. Fraud

8.1. www.kodingtech.com does not request from its Customers or Users, through any means of communication (e-mail/telephone/SMS/etc.), information regarding confidential data, bank accounts/cards or personal passwords.

8.2. The Client / Member assumes full responsibility for the disclosure of his/her confidential data to a third party.

8.3. Www.kodingtech.com disclaims any responsibility in the event that a Member / Client is/is harmed in any way by a third party who claims to be/represent the interests of Www.kodingtech.com.

8.4. The Customer or Member will inform www.kodingtech.com of such attempts, using the contact details.

8.5. www.kodingtech.com does not promote SPAM. Any Member/customer who has explicitly provided their email address on the site may opt to deactivate the customer account associated with this email address.

8.6. Communications made by www.kodingtech.com through electronic means of distance communication (ie e-mail) contain complete and compliant identification data of the sender or links to them, at the date of transmission of the content.

8.7. The following purposes achieved or not will be considered an attempt to defraud the Site/Content and/or kodingtech.com. www.kodingtech.com reserves the right to initiate criminal prosecution against the person(s) who attempted to, or has achieved, these purposes:

  • 8.7.1. to access data of any type of another Member/Client through the use of an account or through any other method.

  • 8.7.3. to affect the performance of the server(s) on which the site runs
  • 8.7.4. to access or disclose to any third party who does not have the necessary legal authority, the content sent by any means by www.kodingtech.com to the Member/Client when he is not the legitimate recipient of the content.

9. Limitation of liability

9.1. www.kodingtech.com cannot be held liable in any way to any Member/Client who uses the Site or the Content, other than within the limits of the articles constituting the Terms and Conditions.

9.2. If a Member/Client believes that Content sent by any means by www.kodingtech.com violates copyright or any other rights, he/she may contact kodingtech.com for details, according to the contact details, so that www.kodingtech.com can make an informed decision.

9.3. www.kodingtech.com does not guarantee the Member or client access to the site or service, in the absence of registration by the latter by completing the registration steps on the site, and does not grant the Member or client the right to download or modify partially and/or fully the content, to reproduce partially or fully the content, to copy, or to exploit any content in any other manner, or to transfer to any third party any content to which he has and/or has obtained access, based on a user agreement, without the prior written consent of kodingtech.com.

  • 9.6.1. the service will be according to the client's requirements
  • 9.6.2. the service will be uninterrupted, secure or free from errors of any kind
  • 9.6.3. the products/services obtained free of charge or for a fee through the service will meet the customer's requirements or expectations

9.7. Within the limits of the provisions of the Terms and Conditions, the operators, administrators and/or owners of the site are in no way responsible for the relationships or their consequences resulting from, but not limited to, purchases, special offers, promotions, promotions, or any other type of relationship / connection / transaction / collaboration / etc. that may arise between the client or Member and any of those who promote themselves directly or indirectly through the site.

10. Force majeure and fortuitous event

10.1. Except in cases where they have not expressly provided otherwise, neither party to a concluded contract, which is still ongoing, shall be liable for the failure to perform on time and/or properly, in whole or in part, any of the obligations incumbent upon it under the contract, if the failure to perform the respective obligation was caused by a force majeure event.

10.2. The party or the legal representative of the party invoking the above-mentioned event is obliged to immediately and completely notify the other party of its occurrence and to take any measures at its disposal in order to limit the consequences of the respective event.

10.3. The party or the legal representative of the party invoking the above-mentioned event is exempted from this obligation only if the event prevents it from carrying it out.

10.4. If, within 15 days from the date of its occurrence, the respective event does not cease, each party will have the right to notify the other party of the full termination of this contract without either party being able to claim any other damages from the other.

10.5. The party invoking the force majeure event must prove the impossibility of performing the obligations within 30 days from the date of occurrence of the event but within the limits of art. 10.3.

11. Litigation

11.1. By using/visiting/viewing/etc. the sites and/or any content sent by www.kodingtech.com to the Member/Client by accessing and/or sending by any means (electronic, telephone, etc.), the Member/Client agrees at least to the provisions of the "Terms and Conditions".

11.2. Any dispute with reference to this Terms and Conditions document that may arise between the Member/Client and www.kodingtech.com will first be resolved amicably.

11.3. Any dispute, of any kind, that may arise between the Member and www.kodingtech.com or its partners, will be resolved amicably. If this is not possible, the conflict will be resolved by the competent court at the headquarters of kodingtech.com, in accordance with the Romanian laws in force.

11.4. If any of the above clauses is found to be null or invalid, regardless of the cause, this clause will not affect the validity of the other clauses.

11.5. This document has been drafted and will be interpreted in accordance with Romanian legislation.

12. Final provisions

12.1. www.kodingtech.com reserves the right to make any changes to these provisions, as well as any changes to the site/its structure/service as well as any content without prior notification to the Member or Client.

12.2. Within the limits of the provisions of the Terms and Conditions, www.kodingtech.com cannot be held responsible for any errors that may appear on the site for any reason, including due to changes, settings, etc., that are not made by the site administrator.

12.3. www.kodingtech.com reserves the right to insert advertising banners of any nature and/or links on any page of the site, in compliance with the legislation in force.
